    1. General Conditions

    By accessing or using the website www.blendviz.com (the “Website”), you (“User”) acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”), as well as all referenced legal documents, including our Legal Notice, Privacy Policy, and Cookie Policy.

    The Website is owned and operated exclusively by GlancingEye S.L., a company incorporated and registered under the laws of Spain, with registered address in the Region of Castellón, and registration number ESB98936289.

    This document governs your use of the Website and the purchase of products and/or services, including:

    • Interior and exterior 3D designs, panoramic 360° views, VR content, 3D models, and custom 3D modeling services.

    • Sale, development, and distribution of high-quality digital 3D models (“Replicas”) representing real-world objects. GlancingEye S.L. retains all intellectual property rights. Some uses may require additional licenses.

    2. Introduction & Definitions

    BlendViz is a brand and service operated by GlancingEye S.L.

    Throughout these Terms, “BlendViz,” “we,” “us,” and “our” refer to GlancingEye S.L.

    By using BlendViz services, you are entering into a contract with GlancingEye S.L.

    Your use of BlendViz is also governed by our Privacy & Cookie Policy, which explains how we collect, use, and safeguard your personal data, in compliance with GDPR and Spanish Law 3/2018 (LOPDGDD).

    Definitions:

    • User: Any natural or legal person accessing or using the Website.

    • Services: Digital products, subscriptions, and offerings on the Website.

    • Subscription: A recurring digital access plan providing ongoing access to 3D content.

    • Digital Product: Any downloadable content, including 3D models and visualizations.

    All rights, titles, and interests in the Website, designs, and digital assets are exclusively owned by GlancingEye S.L., unless stated otherwise.

    3. Eligibility & Account

    3.1 Users must be at least 18 years old and legally capable of entering contracts. Minors require explicit parental/guardian consent.
    3.2 Users must provide accurate, current, and complete registration information.
    3.3 Users are responsible for maintaining account confidentiality and activities under their account. Notify BlendViz of unauthorized use immediately.
    3.4 Users must comply with all applicable laws. Accounts registered by minors without consent may be terminated.
    3.5 BlendViz may refuse or cancel accounts at its discretion, including for suspected fraud or violations of these Terms.

    4. Acceptance of Terms & Modifications

    By using the Website or purchasing products/services, Users agree to these Terms, the Legal Notice, Privacy Policy, and Cookie Policy.

    BlendViz may modify these Terms at any time. Material changes will be communicated via the Website, email, or account notifications. Continued use constitutes acceptance.

    5. Purchase Process & Subscription Plans

    5.1 Subscription Plans:

    • Blendary – Premium 3D Access: €7.99/month (VAT included)
      Unlimited Blender-ready .blend models for animation, games, VR/AR, archviz, and product visuals.

    • Blendary Pro – Advanced 3D Access: €10.99/month (VAT included)
      Includes all Blendary benefits plus request models in .obj, .fbx, or .glb formats, and enjoy 35% off custom 3D model requests.

    • Blendary Ultimate – All-Inclusive Annual Plan: €69.99/year (VAT included)
      Unlock everything in Blendary & Pro, with unlimited downloads, flexible formats, exclusive perks, and one convenient yearly payment.

    5.2 Reduced Price Subscription (Invoice-Based):

    Under Spanish General Tax Law 58/2003, certain subscribers may apply for invoice-based reduced pricing:

    • Blendary: €6.61/month (excl. VAT)

    • Blendary Pro: €9.08/month (excl. VAT)

    • Blendary Ultimate: €57.84/year (excl. VAT)

    Required info: full name, address, postal code, and ID (DNI/NIE or Passport). Requests must be submitted via Contact Us.

    5.3 Non-Subscribers:

    Users without subscriptions may purchase individual 3D models for €5.99 each (VAT included).
    Perfect for occasional users or one-off projects, with full access to high-quality, production-ready 3D assets. Each purchase includes the .blend file, fully prepared and ready to use in your 3D projects.

    5.4 Purchase Steps:

    • Add products/subscriptions to cart.

    • Provide accurate billing and payment details.

    • Confirm payment.

    • Receive email confirmation with download link (valid 24h; renewable via account/support).

    5.5 Legal & Data References:

    All purchases are digital; taxes included where applicable.

    6. Payment Providers

    Payments are securely processed via:

    • Stripe

    • PayPal

    • Banco de Sabadell (custom orders)

    Payment data is handled per applicable data protection laws and provider policies.

    7. Custom Requests & 3D Modeling

    Requests submitted via online form.
    50% upfront payment; 50% upon approval.
    Work begins after upfront payment.

    8. Delivery

    All products are digital only; no physical goods shipped.
    Download links valid for 24 hours; renewable via account or support.
    Subscription content remains accessible only while active.

    9. VAT Compliance & OSS Scheme

    VAT charged per Ley 37/1992 and EU Directive 2006/112/EC.
    BlendViz complies with the EU One-Stop-Shop (OSS) scheme for cross-border VAT.
    Invoices available upon request.

    10. Refund Policy

    • Digital Content Waiver: Under Royal Legislative Decree 1/2007, Users waive their 14-day withdrawal right once digital content is accessed/downloaded.

    • Digital Product Notice: All products offered on BlendViz are digital files only. By purchasing, you acknowledge that you are buying a non-physical, downloadable digital product. Refunds will not be provided if you mistakenly believe you purchased a physical item.

    • General Rule: All payments are final and non-refundable, unless defective or non-conforming.

    • Defective Content: Issues must be reported within 7 days. Refunds or replacements assessed case-by-case.

    • Processing: Approved refunds will be processed within 7–14 business days via the original payment method.

    11. Subscriptions

    Subscriptions auto-renew unless canceled 24h before renewal.
    No partial/prorated refunds.
    Cancel via account or support.
    Renewal notifications sent by email and platform alerts.
    Reactivation requires new account; past data not restored.

    12. License Grant & End-User License Agreement (EULA)

    12.1 License Grant
    All 3D models, digital assets, and related content (“Content”) purchased or downloaded from BlendViz are licensed, not sold. BlendViz (GlancingEye S.L.) grants you a non-exclusive, non-transferable, worldwide license to use the Content for:

    • Personal projects, client work, and internal business use.

    • Commercial projects, including films, animations, visualizations, advertising, and games, provided that the Content is incorporated into a larger creative work and cannot be extracted as a standalone file.

    • Modification and adaptation of Content for integration into your projects.

    12.2 Prohibited Uses
    You may not:

    • Resell, sublicense, redistribute, share, or give away the Content in its original or modified form.

    • Upload the Content to stock marketplaces, NFT platforms, AI training datasets, or any system where third parties could extract or reuse the files.

    • Claim ownership of the Content or represent it as your own intellectual property.

    • Use the Content for unlawful, defamatory, or obscene purposes.

    • The Content may not be used for training artificial intelligence, machine learning models, or similar technologies without a separate written license agreement from BlendViz.

    12.3 Extended/Commercial Licensing
    For mass-market uses (e.g., reselling 3D-printed models, merchandising, or distributing Content within games/apps for sale), a separate extended license is required. Please contact: info@blendviz.com.

    12.4 Ownership

    All intellectual property rights in the Content remain with BlendViz (GlancingEye S.L.) or its licensors. This license does not grant ownership; it only provides the limited rights stated here.

    12.5 Termination
    This license terminates immediately if you breach these terms. Upon termination, you must cease all use and delete all copies of the Content.

    13. User Obligations & Conduct

    Users must:

    • Comply with laws and Terms.

    • Protect account credentials.

    • Avoid unlawful activity, fraud, impersonation, bots, spam, or IP infringement.

    Violations may result in suspension, termination, removal of content, or legal action.

    14. Third-Party Services

    The Website may link to or integrate third-party services. BlendViz is not liable for third-party availability, content, privacy, or policies. Users should review third-party terms independently.

    15. Digital Compatibility Disclaimer

    Users are responsible for ensuring their devices/software support provided formats. No guarantee of cross-platform compatibility.

    16. Warranty & Liability

    16.1 Services Provided “As-Is”
    All digital 3D models, assets, and related services are provided on an “as-is” basis, without warranties of merchantability, fitness for a particular purpose, or non-infringement. BlendViz does not guarantee uninterrupted or error-free access to the Website or digital products.

    16.2 Physical & Health Safety Disclaimer
    The 3D models and assets provided by BlendViz are intended for digital use only. BlendViz is not responsible for any physical, health, or safety issues arising from printing, manufacturing, or otherwise attempting to physically implement these models. Users assume all responsibility for safely handling or producing any real-world objects based on these digital assets. Digital 3D models are not toys, medical devices, or certified industrial designs. Any physical production (including 3D printing) is carried out entirely at the user’s own risk. BlendViz assumes no liability for accidents, injuries, or damages resulting from such use.

    16.3 Limitation of Liability
    To the fullest extent permitted by law, BlendViz’s total liability for any claim, loss, or damage arising from the use of the Website, services, or digital products is limited to the greater of €100 or the total amount paid by the user in the 12 months preceding the claim. This limitation applies to all damages, including direct, indirect, incidental, or consequential losses.

    17. Indemnification

    Users agree to indemnify and hold harmless BlendViz against claims, damages, or expenses arising from:

    • Violation of these Terms.

    • Breach of third-party rights.

    • Uploaded content causing legal claims.

    18. Termination

    BlendViz may suspend or terminate accounts for violations, fraud, or legal/security risks.

    Upon termination:

    • Licenses revoked.

    • Subscriptions canceled (no refunds unless required by law).

    • User data may be deleted (unless retention required by law).

    19. Force Majeure

    BlendViz is not liable for failure/delay caused by events beyond control, including natural disasters, pandemics, war, terrorism, cyberattacks, power outages, or government restrictions.
    If lasting over 60 days, either party may terminate without penalty.

    20–29. General Legal Provisions

    20. Entire Agreement & Severability
    These Terms, together with our Legal Notice, Privacy & Cookie Policy, and EULA (point 12), form the entire agreement between you and BlendViz. If any provision is found invalid or unenforceable, the remainder of the Terms will continue in full effect.

    20.1 Severability & Survival Clauses
    Provisions relating to Intellectual Property, License, Warranty & Liability, Indemnification, and Governing Law shall survive termination or expiration of these Terms.

    20.2 Export Control & Sanctions Compliance
    Users may not access, download, or use BlendViz services or content in violation of EU, U.S., or international export control or sanctions laws. BlendViz disclaims all liability for misuse in restricted jurisdictions.

    21. Assignment
    BlendViz may assign its rights or obligations under these Terms at any time. Users may not transfer or assign their rights without prior written consent from BlendViz.

    22. Beta Features & Changes
    Features on the Website may be experimental or updated without notice. BlendViz may modify, suspend, or discontinue content or services at its discretion.

    23. Governing Law & Jurisdiction
    These Terms are governed by Spanish law. For users residing in Spain, disputes shall be resolved in the competent courts of your domicile. Non-Spanish/EU users submit to the competent courts of Spain, except where mandatory consumer protection laws provide otherwise.

    24. User Data Responsibility & GDPR Compliance
    Users must provide accurate and up-to-date data. BlendViz processes data according to our Privacy & Cookie Policy.

    25. Complaints & Legal Notices
    For formal complaints or legal inquiries, email legal@blendviz.com (subject line: “Complaint – Terms of Use”). BlendViz will respond within 10 business days.

    26. Digital Content Use & EULA Reminder
    All 3D models and digital assets are licensed, not sold. By downloading or using content, you agree to the full terms of the BlendViz EULA (point 12).

    Short note for emails/order confirmations:

    “All downloads are licensed under BlendViz EULA. By downloading, you agree to the terms.”

    27. Digital Compatibility Disclaimer
    Users are responsible for ensuring devices, software, and internet connections support the purchased formats. BlendViz is not liable for corrupted downloads, incomplete files, or incompatibility issues.

    28. Age Restriction
    Our services are intended for users 18 years or older. Minors may only access the Website with parental or guardian consent.

    29. Force Majeure (Extended)
    BlendViz is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, pandemics, war, cyberattacks, or power outages. If the event lasts more than 60 days, either party may terminate without penalty.

    30. Replicas & Intellectual Property Disclaimer

    All 3D models provided by BlendViz are original digital creations, developed independently by our team using publicly available references, images, or general inspiration found online. These models are built from scratch by BlendViz and are not direct copies of any proprietary CAD files, industrial designs, or manufacturer-provided data.

    Any similarity to real-world products, industrial designs, or third-party models is coincidental and represents only our own interpretation or digital replica. For example, just as multiple painters may create their own independent versions of the Mona Lisa based on observation, BlendViz creates its own digital models that may resemble existing items but are built independently from scratch.

    BlendViz explicitly states:

    • All trademarks, product names, and logos are the property of their respective owners. Their appearance in reference images or model descriptions does not imply affiliation, endorsement, or sponsorship.

    • Our models are for digital/creative use only and are not certified as toys, medical devices, or industrial designs. Any physical production (e.g., 3D printing) is at the sole risk of the user.

    • BlendViz is not liable for claims arising from perceived similarities between our digital replicas and any existing physical or digital product.

    • Models may not be uploaded to stock marketplaces, NFT platforms, or used for AI or machine learning training datasets without a separate written license agreement from BlendViz.

    • Users acknowledge that BlendViz replicas are independent creative works and agree to hold BlendViz harmless from any intellectual property, health, or safety-related claims.

    • BlendViz does not provide or distribute manufacturer CAD files, blueprints, or official schematics.
